This case involves Donald Thomas Sharp (Sharp v. Balderas) who is a federal detainee at the Cibola County Correctional Institution. In the last 3 months, he has filed over 40 civil complaints in the United States District Court for the District of New Mexico. In line with his sovereign citizen beliefs, he contends that the United States Treasury must discharge his debts, including this case’s fees.
For some background, Mr. Sharp has been charged with extortion. He allegedly told the National Center for Disaster Hotline that “that Gov. Michelle Lujan Grisham deserved to be killed for her acts of treason in requiring New Mexicans to wear face coverings in public.”
He did admit to calling the hotline and saying that she should be killed for her acts of treason and that he prays she will be sentenced to death. He denied wanting to physically harm her and saying he had the firepower to carry it out.
In 2019 he sent an email to another government agency that said “You have just a few days to go on national television and repent and give testimony against all,” Sharp wrote in an email to Nicley, according to the complaint. “But [if] you have drank the blood or eaten the flesh of babies, do not bother. You get the second death.”
He seems like a dangerous person.
The court did dismiss the most recent civil complaint without prejudice but it looks like he has no intention on stopping filing complaints. He warns:
I have submitted many complaints, and have completed many forms = Application to proceed in District Court without prepaying fees or cost. I have been unemployed since Jan 2015. I have less than $1000. I have a public defender and an EBT card. I should not have to prove this every single time I file a claim. IT IS STUPID! Just look up one I already submitted and stop delaying my court cases. I plan to file many more, so get ready. . . .
